My neighbor’s kid corrupted all my files in my laptop. Can i sue his parents ?
As you all can see the question. My neighbors kid used my laptop, went to some website, caught some kind of virus which deleted and corrupted all my files and everything. Now i am so angry about it, that i want to sue his parents for letting him come to my house and damaging my property. The laptop costed me 0 dollars and in this time i cannot afford another laptop since i have no job . Please give your best advice to solve my problem. Should i sue or threat his parents to buy for me a new laptop ?
( And yes my anti- virus got expired )

Buying a new laptop because it has a virus, is like buying a new car because it has 2 flat tires… Why did you let the neighbor kid use your computer in the first place??? That is your fault!
To fix your computer, get a good FREE anti-virus or reinstall the OS!

If this dose not work, then use those system restore disks that came with your computer to reinstall the OS…

First, talk to the parents, maybe they’ll have the decency to do something about it. Suing is the easy way out, but they are your neighbours.
When I was younger, the dog’s neighbour jumped over into our yard and bit our dog, we had to rush it to the vet, and our neighbour decided to pay for the bill on their own… But I’m from France, and suing isn’t a "tradition" here
First off, the only thing you would be able to sue for is the cost of repair.
Just because he caught a virus does not mean he did any physical damage to the computer. A simple format and os reinstall will solve your issue.
Not to mention the fact that most of your files will be recoverable by someone with basic antivirus experience.
The worst you could sue for would be the cost of repair, which would run around $60-100 and the court costs and lawyer fees would cost way more than that.
Besides, you have absolutely no way to prove that it was not accidental, or that he was negligent.
If you have the Operating System disc, you can restore the Laptop to it’s original state. IF you don’t, write to your laptop manufacturer for one or buy one from http://www.ebuyer.com/ for about £40 it’s under software.
As for your neighbors I wouldn’t recommend sueing them as he is only a kid, probably didn’t know any better.

Also, why dont you try and be a reasonable human being and try to find another way of sorting out disputes other than suing.
Well - to go all legal-speak on you, letting your anti-virus expire was what is called "contributory negligence".
This boils down to meaning it was partly your fault.
Also the fact that you did not have a secure password on your laptop also is another example of "contributory negligence".

You left the laptop out where it could be used by a house visitor.

So - maybe talk to your neighbor about the problem and see if they can offer anything.
If you try to sue them it would be quite easy to prove that you were partly to blame and therefore might have to pay part of the costs of bringing the case to court - which would easily outweigh the cost of any damages you might get.
Plus you will lose any goodwill that exists between you and your neighbor.
Its a tough one but maybe in view of all those things you can accept that you were partly at fault for at least those three reasons stated above. Sh*t happens - and you put yourself in a position where it could happen to you. Try to suck that up like a man and learn from it.
No. You can’t sue them because YOU allowed him to use your laptop. Even if you didn’t know about it. The fact that you allowed it to be accessible to him and for him to use it makes it your fault. (you should watch more "Judge Judy"
First off you are responsible for keeping your anti-virus up to date and since you did not there is nothing that you can do. You will have to reload the OS with the restore disks that were provided when you purchased it. If it did not come with restore disks then you have to the use the restore utility that is stored on the protected volume. Usually an F10 while booting will activate it. Why did you have a kid in your house by himself?
